REGIMENT OF 12^th NATIONAL HEALTH CONFERENCE,
APPROVED ON JUNE 5^th 2003, AND
REVISED ON AUGUST 6^th 2003,
BY THE NATIONAL HEALTH COUNCIL.

CHAPTER I – OF THE GOAL

1^st to 12^th Art. National Health Conference, convoked by Presidential Emendation of May 5^th 2003, will have as goal propose directions to fulfill health as a right of everyone and a State’s duty, as well as to the consolidation of Sistema Único de Saúde (Single Health System) - SUS.

CHAPTER II – OF THE REALIZATION

2^nd Art. The realization of the 12^th National Health Conference will occur in stages, at municipal, state and federal ambit, which will be debated the theme proposed to the national stage.

1^st § The States and Municipalities that have already done their Health Conference the twelve months before the date of publication of this Regiment must do juries as specific, with the following goals:

1. Discuss the theme of 12^th National Health Conference; and
2. Elect the delegates to the subsequent stages.

2^nd § As accomplishment of the municipal stage of 12^th National Health Conference, the reports of Municipal Health Conferences must be send to the State Conferences, having the questions referring to the qualifications and responsibilities of the SUS State and Federal Regiment, thus as the questions that must be send by Bipartite Intermanagers Commissions – CIB and State Health Council.

3^rd § As accomplishment of the state stage at 12^th National Health Conference, the reports of the State Health Conferences must be send to the Organization Commission of the 12^th National Health Conference, having the questions referring to the qualifications and responsibilities of the SUS State and Federal Regiment, thus as the questions that must be send by Bipartite Intermanagers Commissions – CIB and State Health Council.

3^rd Art. The scoop of the 12^th National Health Conference is national, thus as its analysis, formulations and prepositions.

4^th Art. All the delegates, which number and distribution will be previewed at the last part of the Regiment, and guests invited to the 12^th National Health Conference, must recognize the precedence of the national ambit questions and act about them, at analyzing, formulator and incontestable character.

5^th Art. The stages of the 12^th National Health Conference will be done at the following periods:

1. Municipal Stage – until September 30^th 2003
2. State Stage – until October 31^st 2003; and
3. National Stage – December 07^th to 11^th 2003.

1^st § The non-accomplishment of the periods of the stages previewed of the incises I and II at all federal units will not constitute an impeachment to the realization of the National Stage at the previewed period.

2^nd § At all stages, must be assured the whole participation of social segments that act at the health area.

3^rd § The 12^th National Health Conference will happen at Brasília, DF, under the care of Health Ministry.

4^th § The States that, by force majeure, did not do the state conferences until the previewed date of the incise II of this article, must send justifications to the Organization Commission of the 12^th National Health Conference, which will evaluate its pertinence.

CHAPETER III

SECTION I – OF THE THEME

6^th Art. At the terms of this Regiment, the 12^th National Health Conference will have as theme: "HEALTH: A RIGHT OF ALL AND A STATE’S DUTY – THE HEALTH THAT WE HAVE, THE SUS THAT WE WANT", that will discuss from the following thematic axles, contemplating them at each social control ax:

1. Right to Health
2. The Social Security and Health
3. The Health Actions Intersecting
4. The three Government Spheres and the SUS Construction
5. The Organization of Assistance to Health
6. Cooperative Managing
7. The Work at Health
8. Science and Technology and Health;
9. The Health Financing; and
10. Communication and information in health.

Single paragraph. Each theme axe will be discussed at a round-table.

7^th Art. The reference term, of each round-table will observe, the main theme and thematic axles and must have a common analysis of the following aspects:

1. History
2. Positions of different social segments
3. Deliberations of National Conferences and National Health Council
4. Conjuncture, considering the program and the proposals of today’s Government
5. Technical and political informations;
6. Attributions and skill of the three Government sphere; detaching the federal sphere;
7. Presentation of directions proposals; and
8. Measures for Participation and Social Control.

8^th Art. With the goal of propitiated the great and democratic participation of all the segments represented at the Conference and the obtainment of a Final Report that can serve as orientation to SUS at the following years, the round-tables will be followed up by work groups.

SECTION II – OF METHODOLOGY TO ELLABORATION OF REPORTS

9^th Art. At what says respect to the elaboration process of the Final Report of the 12^th National Health Conference, stays established that the reports of the Municipal Health Conferences must be elaborated from the identification of problems and proposals referring to the main theme and thematic axles of 12^th National Health Conference, which determine, responsibility and skill are of sphere state and federal of SUS.

Single Paragraph. It’s recommended that the reports of the Municipal Health Conferences must be send to the Report Commissions of State Health Conferences for consolidation, until 20 (twenty) days before the respective state stage.

10^th Art. The Coordinator Commissions of State stages of 12^th National Health Conference must consolidate the municipal reports at a state report, to be send to the national stage of 12^th Conference, until 20 (twenty) days before its happening, with the goals of:

1. Fundament the debate;
2. Orientate the set of proposals to the state sphere; and
3. Extract the pertinent questions to SUS federal sphere.

1^st § The reports of State Health Conferences must be presented at a resumed version of maximum 05 (five) laud, at space 02 (two) and must be send to the Organization Commission of 12^th National Health Conference.

2^nd § The reports of State stages of 12^th National Health Conference must be send to:

1. At the printed format, through regular mail, to Ministério da Saúde, Secretaria de Gestão Participativa, Comissão Executiva da 12ª Conferência Nacional de Saúde, Esplanada dos Ministérios, Bloco G, 4° andar, Brasília, DF, CEP 70.058-900; and
2. At the electronic format, to the addresses cns@saude.gov.br and conferencia@saude.gov.br.

11^th Art. The Organization Commission and Executive Commission of 12^th National Health Conference will receive the state stage reports consolidating them according to the 12^th National Health Conference theme, observing that, at least, the definitive aspects of the 7^th art. Of this Regiment.

12^th Art. The group’s discussions during the 12^th National Health Conference must fundament at the consolidated of Reports of state stages of 12^th National Health Conference, subsided by debates at tables done during the 12^th National Health Conference and by the following documents:

1. Document of Health Ministry "Diretrizes para a Política de Saúde do Brasil, para o período de 2003 a 2007"; and
2. Text of the National Health Council "O Desenvolvimento do Sistema Único de Saúde: avanços, desafios e reafirmação dos seus princípios e diretrizes".

1^st § The proposals discussed at the groups must have the approval of, at least, 20% (twenty percent) of its members to compose the group’s report.

2^nd § The works at groups will count with coordinators and reporters that will be chosen by the same group.

3^rd § It will be constituted a synthesis reporters’ crew, which composition will be present by the General Reporter of Executive Commission and approved by Organization Commission of 12^th National Health Conference.

4^th § The synthesis Reporters have as responsibility the elaboration of partial reports and the consolidation of each theme report, for approval of General Assembly of 12^th National Health Conference.

5^th § After the previewed phase of 4^th §, the synthesis report crew, coordinated by the General Reporter and by the Associate Reporter, will elaborate the Report final composition of honor/context, that must be approved of General Assembly of 12^th National Health Conference.

6^th § The diverging questions, that the groups’ reports, must be contemplated at the synthesis report and send to the final general assembly, where it will be voted.

7^th § Keeping the representation’s proportionality, almost 75 to 100 groups, composed of 30 to 40 members, will discuss thematic axles.

8^th § It competes to the final general assembly the approval of Final Report and of motion showed by the delegates, according to regiment.

9^th § The Final Report composition, elaborated by the General and Associated Reporter of the Executive Commission, will be submitted to the National Health Group, respecting the approval honor/context of the Final Session of 12^th National Health Conference.

10^th § The Executive Commission will dispose one person to support each group, together with the Coordinator and Reporter.

13^th Art. At the group works, it recommend to treat first of all the defined themes from the following Regiments.

CHAPTER IV – OF ORGANIZATION

14^th Art. The 12^th National Health Conference will be commanded by the State Health Minister and, at its absence or eventual impeachment, by the Executive Secretary of the Health Ministry, according to the established at the Presidential Emendation of May 05^th 2003.

15^th Art. To the organization and development of its activities, the 12^th National Health Conference will count with Organization Commission.

SECTION I – STRUCTURE AND COMPOSITION OF ORGANIZATION COMMISSION

16^th Art. The Organization Commission of 12^th National Health Council is the National Health Council, that to this end it will constitute the following special commissions:

1. Theme Special Commission
2. Communication Special Commission
3. Infra – structure Special Commission
4. Articulation and Mobilization Special Commission
5. Regiment and Rules Special Commission; and
6. Report Special Commission.

Single Paragraph. The Organization Commission of 12^th National Health Conference will count with an Executive Commission, referring by the National Health Council and nominated by the State Health Minister, which will be composed by the following Chairs and Associated members:

1. General Coordinator
2. General Secretary; and
3. General Reporter.

SECTION II – COMMISSIONS ATTRIBUTIONS

16^th Art. The Organization Commission of 12^th National Health Conference has the following attributions:

1. Coordinate, monitoring, directs and promotes the happening of 12^th National Health Conference, assisting to the technical, political, managing and financial aspects.
2. Deliberate on:

1. The 12^th National Health Conference main theme and thematic axles;
2. The methodology of elaboration of 12^th National Health Conference report;
3. The main and complementary tables: themes, expositors, and criteria to choose expositors;
4. The criteria of participation and definition of national and international guests;
5. The proposals of elaboration of reference terms for the main theme and axe themes, aiming orientate and subside the presentation of table expositors; and
6. The number of delegates of the national stage and its distribution by Federal Unit, as well as the percentage of delegates of national entities.

1. Define and accompany the disposition and organization of infra – structure as well as budget to the national stage.
2. Designate the members of Special Commissions, being able to amplify the composition of these whenever it is possible.
3. Deliberate on budget reports done by the Executive Commission.
4. Send to the 12^th National Health conference Final Report to publishing; and
5. Discuss and deliberate on all the questions judged pertinent about the 12^th National Health Conference and not previewed in the other items.

18^th Art. To the Special Theme Commission is due:

1. Propose the main theme and the axe themes of 12^th National Health Conference;
2. Elaborate the reference terms to the main theme and axe themes, aiming to orientate and subsiding the presentation of table expositors;
3. Propose expositors to each round – table; and
4. Elaborate the relation of sub - themes and routines to work of groups.

19^th Art. To the Special Communication Commission is due:

1. Define instruments and mechanisms of divulging of 12^th National Health Conference;
2. Promote the divulging of Regiment of 12^th National Health Conference; and
3. Orientate the activities of Social Communication of 12^th National Health Conference.

20^th Art. To the Infra – Structure Special Commission is due:

1. Propose needed infra – structure conditions to the happening of 12^th National Health Conference, referring to place, equipments and installations, audiovisuals, reproduction, communications, housing, transportation, food and others; and
2. Evaluate, together with the Executive Commission budget informs of all resources destined to the realization of 12^th National Health Conference.

21^st Art. To the Articulation and Mobilization Special Commission, composed by National Health Council Counselors and coordinators of the National Assembly of the Health Council, is due:

1. Stimulate the organization and happening of Health Conferences at all Municipalities and States, as important stages of 12^th National Health Conference;
2. Participate of the municipal and state stages of 12^th National Health Conference;
3. Mobilize and stimulate the parity participation of users with relation to the set of delegates at all stages of 12^th National Health Conference;
4. Mobilize and stimulate the parity participation of health workers, with relation to the sum of managers delegates and health Renders of Services;
5. Strengthen and ease the exchange State – State, aiming the exchange of positive experiences at that concerns to the reach of themes of State Conferences and 12^th National Health Conference; and
6. Stimulate the enrollment of reports of State Health Conferences to Organization Commission of 12^th National Health Conference, at true time.

22^nd Art. To the Regiment and Rules Special Commission is due:

1. Propose the Regiment and Rules of 12^th National Health Conference; and
2. Follow up its accomplishment.

23^rd Art. To the Report Special Commission is due:

1. Propose names to support to groups during the 12^th National Health Conference;
2. Elaborate proposal o methodology to consolidation of reports of groups; and
3. Responsibilize by the consolidated elaboration of work groups.

24^th Art. The Executive Commission has the following attributions:

1. Implement and operate the deliberations of Organization Commission;
2. Receive income of special Commissions for the 12^th National Health Conference, after deliberation of Organization Commission;
3. Subside the Organization Commission and its Special Commissions;
4. Articulate the work dynamic between Organization Commission and Health Ministry;
5. Send orientations to health councils and society’s national entities, related to the subjects approved by the Organization Commission;
6. Stimulate and support the State and Municipal Health Conferences at the preparing aspects to the 12^th National Health Conference;
7. Send managing processes like budget informing to the Organization Commission;
8. Propose the main and complementary tables, with its respective themes, expositors and criteria of choose its names;
9. Obtain together with the expositors the texts of their presentation for archive and divulging ends;
10. Elaborate the budget and provide for the needed supplement, thus as propose the infra – structure of 12^th National Health Conference;
11. Propose the criteria for participation of national and international guests;
12. Propose the reference terms to the main themes and axe themes, aiming to orientate and subside the presentation of table expositors;
13. Propose the methodology of elaboration of Final Report of 12^th National Health Conference;
14. Propose the number of delegates and their distribution by Federal Unit, as well as the percentage of delegates destined to national entities;
15. Decide about urgent questions, ad – referendum of Organization Commission;
16. Convoke technicians of Participative Managing Secretary – SGP, of National Health Council – National Health Conference and other Health Ministry – MS – organs to help it, at temporary or permanent character, at the exercise of its attributions;
17. Providenciate the impression and divulging of Regiments and Rules 12^th National Health Conference;
18. Promote the adequate divulging of 12^th National Health Conference;
19. Articulate, specially with the Health Ministry Cabinet Advisory Communication, aiming the elaboration of a general plan of Conference Social Communication;
20. Articulate with all entities and institutions communication vehicles that compose the National Health Conference, aiming their professional participation at the activities of Social Communication of 12^th National Health Conference;
21. Propose the celebration of needed contracts and covenants to the realization of 12^th National Health Conference;
22. Avail the Health Ministry Executive Secretary at the negotiation of contracts and covenants;
23. Propose, elaborate and do methods of delegates acceptance of national stage and the needed controls;
24. Propose and organize the of Conference’s Secretary;
25. Promote formal contact with the Family and Social Security Commission – CSSF of the House of Representatives, with the Social Subjects Commission – CAS of the Federal Senate and needed instances of Federal Public Ministry, aiming to inform them the following of the organization of 12^th National Health Conference, thus as to divulge it among the instances;
26. Monitor the follow up of the State Health Conferences, through their coordinations, specially at that concerns at the receiving of final reports;
27. Coordinate and do the activities of Social Communication Conference; and
28. Provide the pertinent acts and follow-ups to the expenses with previsions, cronograms and application plans.

Single Paragraph. The Executive Commission will count with technical and managing support of Health Ministry to the realization of needed activities to the performance of its attributions.

25^th Art. To the General Coordinator of the Executive Commission is due:

1. Convoke and participate of meetings of Commission;
2. Coordinate the meetings and activities of the Executive Commission and delegate competencies to its members;
3. Submit to approval of National Health Council the referring subjects of incise II of 17^th art.;
4. Present report of ordinary meetings of Organization Commission of 12^th National Health Conference, informing on the activities developed by the Executive Commission; and
5. Supervision the organization advisory work contracted to this end.

Single Paragraph. The Executive Commission General Coordinator will be substituted, at eventuals impeachments, by the Associate Coordinator.

26^th Art. To the General Secretary is due:

1. Organize the Executive Commission meetings agenda;
2. Participate of Executive Commission ordinary and extraordinary meetings;
3. Organize and keep archive of received documents and copy of send documents due to the realization of 12^th National Health Conference, together with the Executive Commission support service; and
4. Send the documents produced by the Organization Commission and Special Commissions to the Executive Commission of 12^th National Health Conference, for providences and enrollments.

Single Paragraph. The Executive Commission General Secretary will be substituted, at his/hers eventual impeachments, by the Associate Secretary.

27^th Art. To the General Reported is due:

1. Coordinate the Report Commission at the national stage;
2. Coordinate the Discussion Groups reporters work process, heard by the Organization Commission of 12^th National Health Conference;
3. Consolidate the state stage reports and prepare them for distribution to delegates of 12^th National Health Conference, according to previewed on 11^th art.;
4. Coordinate the elaboration of consolidated Discussion Groups;
5. Coordinate the motions’ elaboration and organize motions, approved by the Final Assembly, at the Final Report of 12^th National Health Conference;
6. Coordinate the elaboration of Final Report of 12^th National Health Conference; and
7. Elaborate the Final Report proposal to be presented to the National Health Council.

Single Paragraph. The General Reporter will be substituted, at his/hers eventual impeachments, by the Associate Reporter.

CHAPTER V – OF MEMBERS

28^th Art. The 12^th National Health Conference will count with representatives of public organs, class entities, Health Professional Councils, civil society entities and organizations, users and interessed people at questions relative to health, to sanitary reform and, at particular, at the attention to health for life quality.

1^st § At the terms of 4^th § of 1^st art. of Law n. 8,142, of December 28^th 1990, the presentation of users at all stages of 12^th National Health Conference will be paritarian in relation to the set of representatives of governments, Renders of Services and health professionals.

2^nd § At the terms of the Resolution n. 33/1992, of the National Health Council:

1. 25% of participants will be representatives of the health professionals; and
2. 25% will be managers and health Renders of Services.

3^rd § At the case of segments of managers and health Renders of Services did not fill out the chairs of their respective delegation, during the election of them at the state stages for the 12^th National Health Conference, together with will do the managing of chairs among them.

4^th § The choose of delegates of each segment for the state stage and for the 12^th National Health Conference is of exclusive competence of its respective participants members at the municipal and state stage of 12^th National Health Conference.

29^th Art. The members of national stage of 12^th National Health Conference will be distributed at three categories:

1. delegates with right to vote and voice;
2. guests with right to voice; and
3. observers.

30^th Art. They will be delegates of 12^th National Health Conference:

1. Elected delegates at the state stage of 12^th National Health Conference, according with the following parameters:
   1. The set of elected delegates will be calculated with the population basis and will have proportional size, with relation to the other states, at the total of delegates of 12^th National Health Conference (annex I);
   2. Each State will have, at least, 12 (twelve) delegates in a way that all the segments be represented – managers, health Renders of Services, health workers and users – (annex I and II); and
   3. The final number of delegates by state will be times 4 (four), to give accomplishment to the previewed at the 28^th art. of this Regiment (annex I, II and III).

1. Delegates indicated by govern organs and scope entities and national representativity (annex III), therefore distributed:
   1. Indicated delegates by municipal (CONASEMS), state (CONASS) and federal (Health Ministry) managers;
   2. Indicated delegates by national entities of health Renders of Services;
   3. Indicated delegates by health workers national entities; and
   4. Indicated delegates by consumer defense entities and social movements’ representation system users.

1^st § Between the indicated delegates, at each one of the segments, will incorporate:

1. Chair counselors and their respective first and second associate at the National Health Council; and
2. The coordinators and their respective associates at the national assembly of the health councils.

2^nd § They will be elected, at the municipal and state stages, associate delegates at the proportion of 50% (fifty percent) of total of each segment, for the substitution of chairs at their absence on the 12^th National Health Conference.

31^st Art. There will be invited to the 12^th National Health Conference representatives of national and international organs, entities and institutions and personalities, that have a good action on health and associated sectors, until 5% (five percent) of total of delegates of 12^th National Health Conference.

32^nd Art. There will be observers, at the limit of 10% (ten percent) of total of delegates of each State at the 12^th National Health Conference, people interested to accompany the happening of 12^th National Health Conference.

Single Paragraph. The observers inscriptions will be done at the States must be confirmed according to the number of chairs, from at least ten days of happening of 12^th National Health Conference.

33^rd Art. The inscriptions of Delegates to the 12^th National Health Conference must be done among the Executive Commission, until November 17^th 2003.

Single Paragraph. The members of 12^th National Health Conference, people that have deficiencies and pathology, must register at the inscription paper the kind of deficiency or pathology that they have, with the goal to provide the needed conditions for their participation.

34^th Art. The credentializing of delegates to the 12^th National Health Conference must be done at the States, by the State Organization Commissions of 12^th National Health Conference.

1^st § The Executive Commission of the 12^th National Health Conference will be responsible:

1. By the credentializing of associate delegates; and
2. By the judgement of resources related to delegates’ credentializing.

CHAPTER VI – OF THE RESOURCES

35^th Art. The expenses with the general organization to the realization of the national state of 12^th National Health Conference will happen at the account of the Health Ministry.

1^st § The Health Ministry will pay the expenses with housing of users and workers of the health system, and with the food expenses of all delegates;

2^nd § The expenses with transportation of delegates, from their State origin to Brasília, will be State responsibility; and

3^rd § The Health Ministry will not pay observers’ expenses.

CHAPTER VII – GENERAL DISPOSITIONS

36^th Art. To permit the exchange of experience and the presentation of specific aspects of implantation and functioning of SUS at each Municipality or State of the federation will be defined physical space for expositions, during the 12^th National Health Conference.

37^th Art. The Organization Commission of the 12th National Health Conference will solve the omitted cases at this Regiment.

ANEX I - DEMONSTRATIVE OF CALCULATION OF DISTRIBUTION OF DELEGATES BY STATE

Number of Elected Delegates to the 12^th National Health Conference, by Brazilian Regions and by State, calculated with basis on population criteria, combined with adjustments of minimum and paritarian participation.

ANEX II - DISTRIBUTION, BY SEGMENT, OF DELEGATES TO 12^TH NATIONAL HEALTH CONFERENCE TO BE ELECTED BY STATE

ANEX III – DISTRIBUTION OF DELEGATES, ELECTED AND INDICATED, BY SEGMENT, TO 12^TH NATIONAL HEALTH CONFERENCE

1. There are included, at the total of delegates indicated, the quantitative referring to the national counselors and associates, and the regional coordinators of the national assembly of the Health Council.
